I. General concepts

  • Terms and Conditions – these terms and conditions
  • Website – the website “www.nietuzinkowo.com”, operating at www.nietuzinkowo.com
  • Service Provider – the owner of the website, a natural person – Renata Nicpoń
  • Service Recipient – any natural person accessing the Website and using the services provided through the Website by the Service Provider.
  • Electronic Communication – Communication between the parties by e-mail and through the contact forms available on the website.

II. General provisions

  • These Terms and Conditions set out the rules for the operation and use of the Website and define the scope of the rights and obligations of Service Recipients and the Service Provider in connection with the use of the Website.
  • The subject of the Service Provider’s services is the provision of free tools in the form of the Website, enabling Service Recipients to access content in the form of posts, articles and audiovisual materials, or web applications and electronic forms
  • Any content, articles and information that have the character of tips or advice published on the Website are merely a general body of information and are not addressed to individual Service Recipients. The Service Provider is not liable for the use of them by Service Recipients.
  • The Service Recipient assumes full responsibility for the way the materials made available within the Website are used, including their use in accordance with the applicable law.
  • The Service Provider gives no warranty as to the usefulness of the materials placed on the Website.
  • The Service Provider is not liable for any damage suffered by Service Recipients of the Website or by third parties in connection with the use of the Website. All risk associated with the use of the Website, and in particular with the use and application of the information placed on the Website, is borne by the Service Recipient using the Website’s services.

III. Conditions of use of the Website

  • Use of the Website by each Service Recipient is free of charge and voluntary.
  • Service Recipients are obliged to read these Terms and Conditions and the other documents forming an integral part of them, and must accept their provisions in full in order to continue using the Website.
  • Service Recipients may not use any personal data obtained on the Website for marketing purposes.
  • Technical requirements for using the Website:
    • a device with a display capable of showing web pages,
    • an internet connection,
    • any web browser that displays web pages in accordance with the standards and provisions of the W3C Consortium and supports websites delivered in HTML5,
    • JavaScript support enabled,
    • cookie support enabled
  • In order to ensure the security of the Service Provider, of the Service Recipient and of other Service Recipients using the Website, all Service Recipients using the Website should follow generally accepted online security principles,
  • The following actions, carried out personally by Service Recipients or by means of software, are prohibited:
    • without written consent, decompiling and analysing the source code,
    • without written consent, causing excessive load on the Website’s server,
    • without written consent, attempting to detect vulnerabilities in the Website’s security and in the server configuration,
    • attempting to upload or inject onto the server and into the database any code, scripts or software capable of harming the Website’s software, other Service Recipients or the Service Provider,
    • attempting to upload or inject onto the server and into the database any code, scripts or software capable of tracking or stealing the data of Service Recipients or of the Service Provider,
    • taking any action intended to damage or block the operation of the Website, or to prevent the fulfilment of the purpose for which the Website operates.
  • Where a cyber security incident or a GDPR breach is detected, or where there is a potential for one to occur, Service Recipients should first report the fact to the Service Provider so that the problem / threat can be removed quickly and the interests of all Service Recipients of the Website safeguarded.

IV. Conditions and rules of registration

  • Service Recipients may use the Website without the need to register.
  • Service Recipients must be registered and hold an account on the Website in order to use the additional services provided on the Website, which are available to Service Recipients only after logging in.
  • Registration on the Website is voluntary.
  • Registration on the Website is free of charge.
  • Each Service Recipient may hold only one account on the Website.
  • Technical requirements relating to account registration:
    • holding an individual e-mail account,
  • Service Recipients registering on the Website consent to the processing of their personal data by the Service Recipient to the extent that it was entered into the Website during the registration process, and to its subsequent modification or deletion.
  • The Service Provider has the right to suspend or delete Service Recipients’ accounts at its own discretion, thereby preventing or limiting access to individual or all services, content, materials and resources of the Website, in particular where the Service Recipient breaches these Terms and Conditions, generally applicable law or the principles of social conduct, or acts to the detriment of the Service Provider or other Service Recipients, of the legitimate interest of the Service Provider or of third parties, whether or not cooperating with the Service Provider.
  • All services of the Website may be changed as to their content and scope, added or withdrawn, and also temporarily suspended, or access to them may be limited, at the free discretion of the Service Provider, without the possibility for Service Recipients to object in this respect.
  • Additional security rules concerning the use of an account:
    • Service Recipients registered on the Website are prohibited from sharing the login and password to their account with third parties.
    • The Service Provider has no right to, and will never, request the password to a given account from a Service Recipient.
  • Deleting an account:
    • Every Service Recipient holding an account on the Website is able to delete the account from the Website themselves.
    • Service Recipients can do so after logging in to the panel on the Website.
    • Deleting an account results in the deletion of all of the Service Recipient’s identifying data and in the anonymisation of the username and e-mail address.

V. Conditions of communication and of the provision of the remaining services on the Website

  • The Website provides services and tools enabling Service Recipients to interact with the Website, in the form of:
    • A contact form
    • Commenting on posts and articles
  • The Website provides contact details in the form of:
    • An e-mail address
  • Where a Service Recipient contacts the Service Provider, the personal data of Service Recipients will be processed in accordance with the “Privacy Policy“, which forms an integral part of these Terms and Conditions.
  • Conditions for the posting of content by Service Recipients on the Website:
    • It is prohibited to post on the Website content that is offensive or defamatory towards the Service Provider, other Service Recipients, third persons or third-party entities,
    • It is prohibited to post on the Website text, graphic or audiovisual materials, scripts, programs and other works for which the Service Recipient does not hold a licence, or whose author of the economic rights has not consented to free publication,
    • It is prohibited to post on the Website content that is vulgar, pornographic or erotic, or contrary to Polish and European law, and also links to pages containing such content,
    • It is prohibited to post on the Website scripts and programs that place excessive load on the server, illegal software, software used to breach security measures and other similar actions, and also links to pages containing such materials,
    • It is prohibited to post on the Website marketing content and content advertising other commercial websites, products, services or commercial web pages

VI. Collection of data about Service Recipients

In order to provide the Website’s services properly, to safeguard the legal interest of the Service Provider and to ensure that the operation of the Website complies with the applicable law, the Service Provider collects and processes certain data about Users through the Website.

In order to provide services properly, the Website uses and saves certain anonymous information about the Service Recipient in cookies.

The scope, purposes, manner and rules of data processing are available in the appendices to these Terms and Conditions: “GDPR information obligation” and in the “Privacy Policy“, which form an integral part of these Terms and Conditions.

  • Data collected automatically:
    For the smooth operation of the Website and for statistics, we automatically collect certain data about the Service Recipient. This data includes:

    • Screen resolution
    • Approximate location
    • Website subpages opened
    • Time spent on a given subpage of the website
    • Operating system type
    • Address of the previous subpage
    • Referring page address
    • Browser language
    • Internet connection speed
    • Internet service provider
    • Anonymous demographic data based on Google Analytics data:
      • Gender
      • Age
      • Interests

    The above data is obtained through the Google Analytics script and is anonymous.

  • Data collected during registration:
    Username, first name and surname, e-mail address. In the case of logged-in Service Recipients (holding an account on the Website), an identifier of the Service Recipient linked to their account may be placed in the cookies saved on the Service Recipient’s device

VII. Copyright

  • The owner of the Website and of the copyright to the website is the Service Provider.
  • Some of the data placed on the Website is protected by copyright belonging to companies, institutions and third parties not connected in any way with the Service Provider, and is used on the basis of licences obtained or on the basis of a free licence.
  • Pursuant to the Act of 4 February 1994 on Copyright, it is prohibited to use, copy or reproduce in any form, or to store in search systems – with the exception of the Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn search engines – any articles, descriptions, photographs or any other content, graphic, video or audio materials found on the Website, without the written consent, or consent given by means of Electronic Communication, of their legal owner.
  • In accordance with the Act of 4 February 1994 on Copyright, simple press information is not protected, understood as information alone, without the commentary and assessment of its author. The author understands this as the possibility of using information from the texts placed on the website, but not of copying articles in whole or in part, unless this has been indicated in the particular material made available on the Website.

VIII. Changes to the Terms and Conditions

  • All provisions of these Terms and Conditions may be changed unilaterally by the Service Provider at any time, without giving reasons.
  • Information about a change to the Terms and Conditions will be sent by Electronic Communication to Service Recipients registered on the Website.
  • Where the Terms and Conditions are changed, their provisions come into force immediately upon publication for Service Recipients who do not hold an account on the Website.
  • Where the Terms and Conditions are changed, their provisions come into force with a 7-day transitional period for Service Recipients holding accounts on the Website registered before the change to the Terms and Conditions.
  • Every Service Recipient who continues to use the Website after a change to the Terms and Conditions is deemed to accept them in full.

IX. Final provisions

  • The Service Provider is not liable in any way, as far as the applicable law permits, for the content transmitted and published on the Website by Service Recipients, for its truthfulness, reliability, authenticity or legal defects.
  • The Service Provider will make every effort to ensure that the Website’s services are offered continuously. It bears no liability, however, for disruptions caused by force majeure or by unauthorised interference by Service Recipients, third parties or the activity of external automated programs.
  • The Service Provider reserves the right to change any information placed on the Website at a time of its choosing, without the need to notify in advance the Service Recipients using the Website’s services.
  • The Service Provider reserves the right to shut down the Website temporarily, in whole or in part, in order to improve it, add services or carry out maintenance, without notifying Service Recipients of this in advance.
  • The Service Provider reserves the right to shut down the Website permanently, without notifying Service Recipients of this in advance.
  • The Service Provider reserves the right to assign, in part or in whole, all of its rights and obligations connected with the Website, without the consent of Service Recipients and without the possibility for them to raise any objection.
